Draft, to review before launch. This text isn’t final and has no legal effect yet.

Thank you for using Anidola. These terms explain what you get, what you can expect from us and what we ask of you. We’ve tried to keep them short and in plain language. Please read them before you buy; by using Anidola, you agree to them.

1. Who we are

Anidola is run by Anidola Technologies LLC, a company registered in New York, United States, under number 8032062 (DOS ID), with its business address at 2100 Nesconset Highway #1082, Stony Brook, New York 11790, United States. In these terms, “we” and “us” mean Anidola Technologies LLC, and “you” means the person using Anidola.

You can reach us at support@anidola.com. Our representative in the European Union for data protection is [name and address].

2. What Anidola does

Anidola brings together official public data about a Belgian address, such as its energy performance, flood and soil risks, planning and permits, and local price trends, and presents it in one report.

The free check shows a colour-coded result for flood, soil and energy. The full report shows every category with the details behind each result, an overall score, questions to ask the seller, the agent or the notary, and a downloadable PDF. You can buy a full report on its own or with a house-hunt pass.

3. A guide, not advice

Anidola helps you understand a property before you commit to it. It is not legal, financial, technical or tax advice, and it does not replace the official certificates, the checks your notary carries out, or an inspection by a surveyor or architect.

Every fact in a report shows where it comes from and when we retrieved it. Public sources can be incomplete, out of date or wrong, and they can change after your report is made. Before you sign anything, always check the points that matter to you with the official source or a professional.

A card that finds nothing doesn’t prove there is nothing: a source may be incomplete, and some works need no permit at all.

4. Prices and payment

All prices for individual buyers include VAT. The price you pay is the one shown at checkout.

You buy from [Stripe entity name], which resells Anidola’s reports and subscriptions as seller of record and issues your receipt and invoice. Anidola Technologies LLC provides the report and the service and is responsible for them toward you under these terms. Your rights of withdrawal, refund and legal guarantee apply in full whichever of us you contact. Stripe takes your payment by card, Bancontact or digital wallet and handles VAT. We never see or store your full card details.

5. Your account and your report links

You must be at least 18 to buy from Anidola. You can use the free check from 16.

You don’t need an account to buy a single report: after paying, you can read it in the browser you bought it in until you close it. We also email you a private link; it opens the report once you’re signed in with the email address you paid with (an account is free), and the report then stays in your account. Codes and the other products need an account. You may share a report with up to three people, who read it signed in with the email address you gave.

If you create an account, you can save addresses and find all your reports in one place. Please keep your login details safe, and let us know straight away if you think someone else has used your account.

6. Using your report

A report is for your personal use while you’re looking for a home. You’re welcome to share it with the people helping you decide, such as your family, your notary, your bank, your surveyor or your architect.

You may not sell, publish or share a report, its PDF or its link for commercial purposes without our written permission. Commercial use means using reports as part of a business that buys, sells, lets, develops or markets property, or advises others on it, for example as an estate agent, property dealer, developer, professional investor or property-listing site. It also covers any resale or redistribution of reports, such as on a website, in a listing, a brochure or a newsletter. A notary, bank, surveyor or architect who reads your report to help you with your own purchase isn’t commercial use. Professionals who want to use or share reports can do so with an agency subscription (see section 7).

If we have good reason to think an account or report link is being used commercially, we may suspend it and ask you how you’re using it, for example which listings or websites you found the properties on. If your use turns out to be personal, we’ll restore access straight away and extend your pass or link by the time it was suspended. If you don’t reply within 30 days, or the use was commercial, we may close the account or disable the link without a refund.

A business that uses reports commercially without a subscription agrees to pay us, for each report used that way, the current price of a single full report, or the price of the agency subscription that would have covered that use if that is higher. This doesn’t limit our other rights under the law.

7. Agency subscriptions

Agency subscriptions are for estate agencies and other property professionals. Prices are yearly and shown excluding VAT. At checkout, the agency gives its business name and VAT number, and VAT is added where it applies.

With a subscription, the agency can add its listings, up to the number its plan allows each year, and share a report link for each one. Any buyer who opens that link can read the full report for free. The agency may present the report as offered by them, but may not change its content. On a Network plan, or an agency pass without a team cap, the team uses the agency’s own email domain: invitations go only to addresses on it (support can add domains), and an invitation is accepted only by the address it was sent to.

During a subscription year, the agency may upgrade to a higher plan. The upgrade takes effect immediately, the renewal date remains unchanged and the price difference for the remainder of the year is charged at once. The agency may also buy additional listings in packs, paid once and valid until the end of the current subscription year; unused listings do not carry over and are not refunded.

The subscription renews automatically each year unless it’s cancelled at least 30 days before the renewal date. After cancelling, it stays active until the end of the paid year. Because it’s a business purchase, there is no 14-day right of withdrawal.

The agency is responsible for how it presents reports in its listings and marketing. It will compensate us for any claim by a third party that results from the agency breaking these terms, including reasonable legal costs.

As the only exception, an agency on a Growth or Network plan may leave optional cards out of its listings’ reports, such as the questions to ask or the neighbourhood. It can never leave out the score, the red flags or any topic’s findings, and the report says what was left out. A buyer who has their own access to the report sees it complete.

When you share a report with a client, the guide-not-advice notice, the source of each card and the date it was checked stay in it; you can’t change what a card says. A report doesn’t replace your own duty to inform your client or buyer.

8. Promo codes and agency passes

We sometimes offer promo codes (each worth one full report) and agency passes (an agency subscription for a set number of months and listings). They’re personal, can be used only once, can’t be exchanged for money and may have an expiry date. An agency pass follows the rules in section 7, except that it doesn’t renew.

9. Your right of withdrawal

Online purchases normally come with a 14-day right of withdrawal. A report is digital content we deliver straight away, so at checkout we ask you to agree that we deliver it at once and to confirm you know you then lose that right (article VI.53, 13° of the Belgian Code of Economic Law). We confirm this by email, with these terms, as soon as you’ve paid, so you can keep a copy.

For a house-hunt pass, the same applies: the pass starts as soon as you buy it, and the report you buy it from opens with it straight away.

If you withdraw within 14 days of buying a house-hunt pass, we refund the reports you haven’t opened yet, in proportion to the pass’s price.

This doesn’t affect your rights if a report is faulty or not delivered: in that case, contact us and we’ll fix it, replace it or refund you. If you’re charged more than once for the same purchase because of an error on our side, tell us as soon as you notice and we’ll refund the extra charge.

10. Fair use of Anidola

Please use Anidola as it’s meant to be used. In particular, you may not:

We may suspend or close an account that breaks these rules.

We reserve our website, reports and texts against text and data mining (article 4(3) of Directive 2019/790). Copying them by automated means, or using them to train or improve AI models, needs our written consent.

11. Our content and the public data we use

The design of Anidola, its reports, scores, texts and software belong to us and are protected by copyright and other intellectual property rights. Buying a report gives you the right to use it as described in section 6, not ownership of it.

The public data in our reports remains subject to the licences of the authorities that publish it. Each report credits its sources. [List of sources and licences, to be confirmed.]

12. Availability

We work to keep Anidola available and accurate, but we can’t promise it will always run without interruption. We may need to pause it for maintenance, and public data sources are sometimes unavailable. When a source doesn’t answer while your report is made, the report shows which part is missing; we ask that source again automatically for 7 days and, once it answers, complete your report and email you. If a part is still missing after those 7 days, contact our support and we’ll help you get that information.

13. Our responsibility

We show public data as the official sources publish it, and we take care in how we combine and present it. We can’t guarantee that the sources are complete, correct or up to date.

We are not responsible for decisions you make on the basis of a report, such as whether to visit, make an offer on or buy a property. Where the law allows us to limit our liability, it is limited to the amount you paid for the report or pass concerned.

Nothing in these terms limits our liability for intentional misconduct or gross negligence, for death or personal injury, or in any other case where the law doesn’t allow it to be limited, nor if we don’t deliver at all what you paid for. Nor does it affect the rights you have as a consumer under Belgian or EU law. Your legal guarantee also applies in full: if a report or service doesn’t match what we described, we’ll fix it, replace it or refund you.

14. Your personal data

We only collect what we need to provide Anidola: your email address, your language, your saved addresses and purchases, and the email addresses you share a report with. If you buy without an account, we keep the email address you give at checkout. Our privacy policy explains how we use and protect your data and how to exercise your rights.

15. Claiming your home

If you have the full report for an address, you can claim the home as its owner, co-owner or heir. Claiming is free. It doesn’t give access to the full report: you need to have it already.

By claiming, you confirm that you own the property or are a co-owner or heir of it. A false claim is a reason to close your account (section 6).

The details you give about your home stay private: only you see them, in your owner view. They don’t change the official data. If you think official data is wrong, tell us and we’ll check the source.

There is one claim per home. If someone else has already claimed yours, contact us: we’ll ask you for a proof of ownership (such as the notary deed or the property tax bill), check it, keep only its kind and the date, and delete it. We may then move or end the claim. You can end your own claim at any time; your details for the home are then deleted.

Anidola’s Home Companion is free for one home you have claimed. You sign up once, accepting these terms, choose the home it covers (you can change it) and the email alerts you want; every alert is off until you turn it on. You can turn it off at any time: alerts and reminders stop, and your home’s report is then kept for 24 months from that day. What you entered stays, and comes back if you turn it on again.

Anidola’s Home Companion Plus is a yearly subscription for your account, at the price shown when you subscribe, VAT included, on top of the free version. It covers every home you claim, and you choose how far around your homes the permit alerts look (100, 250 or 500 m; the free version looks 250 m around). If you bought the full report or a pass for one of them, the first month is free, once per account. It renews each year until you cancel; you can cancel at any time, and it then stops at the end of the paid year, when the free version covers your one home again. You can withdraw within 14 days of subscribing: we refund what you paid, minus the days used. If your last claimed home’s claim ends or you close your account, Plus stops at once, without a refund of the running year.

The obligations calendar of Anidola’s Home Companion is a reminder service built on your region’s official rules, each shown with its source and the date we last checked it. It isn’t legal advice: the law applies whether or not a reminder reaches you, and a missing or late reminder doesn’t change your obligations. The dates you record stay private, and are deleted when your claim ends.

16. Professional subscription

The Professional subscription is for businesses and self-employed professionals, such as investors, buyer’s agents, brokers and renovation advisers. Prices are yearly and shown excluding VAT; at checkout you give your business details and VAT number, and VAT is added where it applies. Because it’s a business purchase, there is no 14-day right of withdrawal.

During each subscription year, you may open full reports for up to the number of addresses your subscription includes, and buy more addresses in packs valid until the end of that year. Unused addresses don’t carry over and aren’t refunded. Addresses you’ve opened stay open after the year ends.

As an exception to section 6, you may share a report and its PDF with your own client for the address it covers, as part of your work for that client, with the report’s sources and attribution kept. You may not resell reports, publish them, or pass them on in bulk. A report is information from public sources, not a valuation or professional advice, and you remain responsible for the advice you give.

When you share a report with a client, the guide-not-advice notice, the source of each card and the date it was checked stay in it; you can’t change what a card says. A report doesn’t replace your own duty to inform your client or buyer.

The subscription renews automatically each year until you cancel it. After cancelling, it stays active until the end of the paid year.

17. Changes to these terms

We may update these terms from time to time, for example when we add features or when the law changes. We’ll show the date of the latest version at the top. If a change affects you significantly, we’ll tell you by email or on the site before it takes effect. Each purchase is under the terms in force that day; your confirmation email includes them. If we change the terms of a subscription in a way that’s worse for you, we tell you at least 30 days before, and you can cancel it at no cost before the change applies.

18. Closing your account

You can close your account at any time from your settings or by emailing us. Reports you’ve bought remain available through their links until those links expire.

19. Questions and complaints

If something isn’t right, please email us at support@anidola.com and we’ll reply within 5 working days. If we can’t resolve your complaint together, you can contact the Belgian Consumer Mediation Service (Service de Médiation pour le Consommateur / Consumentenombudsdienst) at mediationconsommateur.be.

20. Applicable law and courts

These terms are governed by Belgian law; if you’re a consumer, you also keep the protection of the mandatory rules of the country where you live. If you’re a consumer, you can go to the courts where you live, and we can only take you to court there. For business customers, the courts of Brussels have exclusive jurisdiction.

21. Other terms

If a court finds part of these terms invalid, the rest stays in force. For business customers, the invalid part is replaced by a valid provision as close as possible to its original purpose. If we don’t enforce one of our rights straight away, that doesn’t mean we’ve given it up.

These terms exist in Dutch, French, German and English. All have the same value; if they differ, the version most favourable to you applies.

In short

Anidola is a guide based on official public data, not legal, financial or technical advice. It helps you ask the right questions; it doesn’t replace the official certificates, your notary or a surveyor. Your report is for you and the people helping you buy, and agencies that want to share reports do so with a subscription.
